GPSR authorised representative: free written mandate template

A manufacturer may appoint an authorised representative in the EU by written mandate (Article 10(1)). For a manufacturer outside the EU with no EU importer, that representative is usually the responsible person the GPSR requires. Fill in the form to get a mandate to review, print and sign.

2. Tasks

The authorised representative shall perform the following tasks on behalf of the manufacturer (Article 10(2)):

  1. provide a market surveillance authority, on its reasoned request, with all information and documentation necessary to demonstrate the safety of the products, in an official language which can be understood by that authority;
  2. where it considers or has reason to believe that a product is dangerous, inform the manufacturer;
  3. inform the competent national authorities, through the Safety Business Gateway, of any action taken to eliminate the risks posed by the products, where the manufacturer has not already provided that information, or on the manufacturer's instruction;
  4. cooperate with the competent national authorities, at their request, on any action taken to eliminate effectively the risks posed by the products;
  5. provide a copy of this mandate to the market surveillance authorities on request.

3. Responsible person

The authorised representative is the economic operator established in the Union that is responsible for the products under Article 16(1). It shall perform the tasks in Article 4(3) of Regulation (EU) 2019/1020 and, where appropriate with regard to the possible risks, regularly check that the products comply with the technical documentation and with Article 9(5), (6) and (7), and provide documented evidence of these checks on request (Article 16(2)).

The manufacturer shall indicate the name and contact details of the authorised representative on the products, their packaging, the parcel or an accompanying document (Article 16(3)), and in its online offers (Article 19).

4. Duties of the manufacturer

The manufacturer shall give the authorised representative the technical documentation (Article 9(2)) before the products are placed on the market and keep it up to date; inform it without delay of any risk, complaint, accident or corrective measure concerning the products; and give it any other information it needs to perform its tasks. The manufacturer remains responsible for its own obligations under the Regulation.

What the mandate must allow

The representative performs the tasks set out in the mandate, and the mandate must allow at least these (Article 10(2)):

  1. giving a market surveillance authority, on its reasoned request, all information and documentation needed to show the product is safe, in an official language that authority understands;
  2. informing the manufacturer when it believes a product is dangerous;
  3. informing the authorities, through the Safety Business Gateway, of action taken to eliminate risks, where the manufacturer has not already done so or on the manufacturer's instruction;
  4. cooperating with the authorities, at their request, on action to eliminate the risks of the products covered.

The representative must give a copy of the mandate to the market surveillance authorities on request (Article 10(2)).

When the representative is also the responsible person

If the representative is your responsible person under Article 16, it also takes on the tasks in Article 4(3) of Regulation (EU) 2019/1020, such as keeping the technical documentation available for the authorities. Where appropriate to the risks, it regularly checks that the product matches its documentation and labelling (Article 16(2)). Its name and contact details must appear on the product, packaging, parcel or an accompanying document (Article 16(3)), and in your online offers (Article 19).

Who can be the representative

Any person or company established in the EU (Article 3(9)). Many service providers offer this for a fee. Check that they are established in the EU, can answer authorities in the languages of your markets, and will have your technical documentation at hand.

What this template does not cover

  • fees, liability, insurance and indemnities;
  • the law that governs the contract and the courts that decide disputes;
  • notice periods for ending the mandate;
  • duties under other EU law, such as the CE marking laws, which set their own rules for authorised representatives.
