What the notice must contain
- the headline "Product safety recall";
- a picture, the name and brand of the product, its identification numbers and, if available, when, where and by whom it was sold;
- a clear description of the hazard;
- what consumers should do, including to stop using the product immediately;
- the remedies on offer;
- a free phone number or an online service for more information;
- encouragement to share the notice, where appropriate.
It must be in the language or languages of each country where the product was sold (Article 36(2)).
Words you must not use
Nothing that lowers the consumer's perception of the risk: terms such as "voluntary", "precautionary", "discretionary", "in rare situations" or "in specific situations", or saying that no accidents have been reported (Article 36(2)(c)). The generator flags these words.
Remedies
The remedy must be effective, free and timely. Consumers must get a choice of at least two of repair, replacement with a safe product of the same type and at least the same value, or a refund of at least the price paid; only one where the others are impossible or disproportionately costly. Consumers never pay to return the product (Article 37).
Reaching consumers
Notify every affected consumer you can identify directly, using the customer data you hold. Where that is not enough, publish the notice through other channels: your website, social media, newsletters, shops and, if needed, the media, in an accessible form (Article 35). Also inform the authorities through the Safety Business Gateway; see Accidents and recalls.
Not sure who must run the recall? Your role decides it; check with the GPSR check.
